AUSTIN—The Texas Department of Insurance announced enforcement actions taken by Commissioner Mike Geeslin that became final during December 2009. The actions include eight license revocations, four license denials or probations, and fines and restitution totaling $94,059. Elias J. De La Garza, Houston (090970, 12/4/2009) general property and casualty license and general life, accident and health license revoked, must pay restitution; misappropriated or converted money belonging to an insurer or insured, failed to respond to requests for information in a timely manner.

San Jacinto Title Services of Corpus Christi LLC, San Jacinto Title Services of Aransas County LLC, Corpus Christi, Rockport (091001, 12/14/2009) must pay restitution of $25,198; violations of Texas Title Insurance Act provisions concerning proper examination of title.

An order imposing disciplinary measures becomes final 20 days after the agent or insurance company has received notice of the order, unless a motion for rehearing is filed within that period. A motion for rehearing stays the finality of an order until the Commissioner of Insurance acts upon the motion or upon the operation of law. Commissioner’s orders are subject to appeal to state district court.

Fee” Worrisome

WASHING TON— The American Insurance Association (AIA) responded to the Administration’s announcement of a “Financial Crisis Responsibility Fee” on Jan. 14.

Speaking on behalf of AIA, Blain Reth-meier commented, “Until we see the final details, it’s unclear how this tax will impact the property-casualty industry. As is the case with the regulatory reforms being considered, the industry should be recognized and not penalized for the low-risk it poses to the broader financial system, the nature of our business and regulatory standards, and our existing resolution and guaranty processes. Imposing a tax like this sets a bad precedent and once you go down this road, you don’t know where it will stop.”
